SERVICE TERMS AND CONDITIONS

  1. Pre-Application Conditions
  2. Customer Site Preparation and Installation Day Requirements – Prior to the arrival of Rock-It Coatings to apply the product, it is the Customer’s responsibility to ensure that the “Service Area” (all walls and floors designated for application) is free of obstructions. The area must be entirely clear. Failure to clear the area will incur a $250 charge for item removal and potentially result in rescheduling. The customer must be present at the start and completion of the work for inspection, final approval, and payment. Access to household electrical outlets must be provided by the customer.
  3. Rescheduling – The Customer may reschedule the service at least 48 hours before the set appointment without penalty. Rescheduling within 48 hours will incur a $250 fee. If rescheduling is necessitated by the failure to meet the conditions outlined in (a), an additional $250 fee will apply.
  4. Limitation of Liability
  5. Rock-It Coatings will not be liable for indirect, incidental, punitive, or consequential damages arising from the sale or installation of products, nor for any damages to the structure or personal property within the work area.
  6. Rock-It Coatings will not be responsible for damages to property caused during scheduled removal or due to the client’s failure to clear the area.
  7. Disclaimer of Anti-Slip Properties – Rock-It Coatings does not guarantee or warrant against slipping and any anti-slip characteristics of the materials. It is imperative for all customers, both current and prospective, to understand and acknowledge the following:
    • No Implicit Guarantees: Rock-It Coatings, despite its commitment to quality and the incorporation of features aimed at reducing slipperiness, does NOT guarantee or warrant that slipping will never occur on treated surfaces. The anti-slip properties of our coatings are provided as is, without any form of guarantee that slipping or falls will be completely eliminated.
    • User Responsibility: The responsibility lies with you, the customer, to thoroughly evaluate and determine the suitability and appropriateness of using Rock-It Coatings’ products for your specific application, setting, and environment. Various external conditions, such as the presence of water, oils, or other lubricants, as well as the nature of foot traffic (e.g., types of footwear), can significantly affect the performance of our coatings regarding slip resistance.
    • Proper Maintenance and Care: It is crucial to note that the anti-slip efficacy of our coatings can also be affected by wear and tear over time, as well as by how the treated surfaces are maintained and cleaned. Proper, regular maintenance as per our guidelines is essential in sustaining the anti-slip characteristics of our products.
    • Assumption of Risk: By choosing to use Rock-It Coatings products, users must acknowledge and accept the inherent risks associated with walking on treated surfaces, including the potential for slipping and falling. It is the user’s obligation to take all necessary precautions and adhere to all recommended safety and precautionary measures when applying and using our products.
  8. Limited Warranties – No express or implied warranties, whether of merchantability or fitness for any particular use, or otherwise (except as to title), beyond those explicitly stated by Rock-It Coatings shall be deemed valid. Any changes to these terms must be in writing and signed by a president or vice president of Rock-It Coatings. Local laws may adjust the applicability of these limitations.
  9. Rock-It Coatings offers no assurances on the prevention of reoccurring cracks in floors or walls after application. Service repairs due to structural issues or customer negligence will be the customer’s financial responsibility. No returns, cancellations, or refunds are permitted for custom orders. Rock-It Coatings reserves the right to reschedule without penalty under certain conditions. A cancellation by the customer within three days of signing is penalty-free; subsequently, any deposit becomes non-refundable.
  10. Precedence of Terms – These conditions override any conflicting terms in other documentation concerning the purchase, and this contract constitutes the full agreement between parties regarding the sale of goods.
  11. Governing Law – Florida law will govern this agreement, with legal actions exclusively in Leon County.
  12. Legal Fees – In legal actions arising from payment disputes, the prevailing party is entitled to attorney fees and costs, including appeals. Each party will bear their own legal costs otherwise.
  13. Job Acceptance – Rock-It Coatings reserves the right to cancel or reject any service as deemed appropriate.
  14. Surface Finish – The ultimate surface may vary and will not necessarily be smooth. It will mirror the underlying concrete condition. Thickness and appearance are subject to discretion by Rock-It Coatings installers. Any subsequent touchups may not entirely blend with the original finish.

Payment Terms – 50% of the total is due at contract signing, including a $500 non-refundable deposit. The balance is due upon project completion.

Crack Repair – Visible cracks are priced at $7 per linear foot for repair. Additional uncovered cracks post-coating removal or grinding will also be repaired at the same rate.
